Snow and Ice Service Agreement
A starting point, not legal advice. Laws differ by province and state: have a lawyer where you work review it before you use it.
1. Parties
This agreement is between ________________ (the "Contractor"), ________________, and ________________ (the "Client"), ________________.
2. Property and services
The Contractor will provide the services below at:
- Property: ________________
- Service: Plowing of parking lots, driveways and drive lanes
- Service: Clearing of walkways, steps and entrances
- Service: De-icing (salt or another de-icer) of drive and parking areas
- Service: De-icing of walkways, steps and entrances
3. Term
This agreement runs from ________ to ________, unless it is ended earlier under section 10.
4. When service happens
Plowing and clearing start once snow on the property reaches 5 cm. During a long snowfall the Contractor may clear more than once.
The Contractor aims to finish within ________ hours after the snow stops. Larger storms, equipment breakdowns and road conditions can delay service; the Contractor will tell the Client when a delay is expected.
De-icing is applied when ice is present or expected on the areas in section 2, or when the Client asks for it.
5. Price
Seasonal price: $________ for the term, for the services in section 2, paid in ________ equal payments.
The seasonal price does not change with the number of storms in the term.
De-icing in section 2 is included in the seasonal price, material included.
6. Payment
Invoices are due within 30 days. Taxes are added where the law requires them.
If an invoice is unpaid after its due date, the Contractor may pause service after giving written notice, and amounts owed remain owed.
7. Records
The Contractor keeps a record of each visit: the date and time, the services done, and the de-icing material used. The Client may ask for a copy.
8. The Client's part
The Client will mark curbs, drains, landscaping, and anything else that could be damaged under the snow, and tell the Contractor about hazards on the property.
The Client will move vehicles and other obstacles where it can, so the areas can be cleared, and will report any concern about the service promptly so it can be looked at while the conditions are still visible.
9. Liability and insurance
The Contractor carries general liability insurance of at least $________ and will show proof on request.
Snow and ice can form again between visits, and no service can keep a surface free of snow and ice at all times. The Contractor is responsible for damage it causes through its own negligence, and not for damage to items that were not marked or disclosed, or for wear to surfaces from normal snow clearing.
10. Ending the agreement
Either party may end this agreement with 30 days' written notice. Services provided up to the end date are paid for; for a seasonal price, the parties settle the amount in proportion to the part of the term that was served.
11. Not included
Unless listed in section 2: roof snow, ice dams, hauling snow off the property, and areas blocked by vehicles or objects at the time of service.
12. Whole agreement
This document, with anything attached to it, is the whole agreement. Changes must be in writing and signed by both parties. It is governed by the laws of the province or state where the property is located.
